The Town of Kill Devil Hills will have a temporary path closure beginning at 12:00 p.m. on Wednesday, March, 10, 2021 for repairs and resurfacing by Rose Brothers Paving of the multiuse paths in two locations:
  • Wright Brothers Monument Path – From cul-de-sac on W. First Street to Colington Road and continuing on the north side of Colington to Veterans Drive.
  • Colington Road Path – From Bermuda Bay Blvd. to Mustian Street on the south side of Colington Road.
Sweeping, shoulder clipping and patching will begin today.  Please use caution.  Asphalt overlay is planned for Thursday, March 11 through Friday, March 12 and access will be prohibited.  Any path use including access to the First Flight Schools shall make alternate arrangements during these paving days.

The temporary road closure is scheduled to end by 5:00 p.m. on Friday, March 12, 2021.

PUBLIC NOTICE OF POTENTIAL SALE
OF REAL PROPERTY BELONGING TO THE TOWN OF KILL DEVIL HILLS


NOTICE is hereby given that the Town of Kill Devil Hills, NC has received a valid offer, including the required 5% bid deposit, to purchase three parcels of real property, a total of 43,500 square feet, located at 2011 South Croatan Highway and 0 South Croatan Highway adjacent thereto, and 2032 Wrightsville Avenue, for the total sum of $1,505,000, and further identified as Dare County Tax Parcels:

1. # 026186000
2. # 008351000
3. # 008350000

At their Monday, March 8, 2021 meeting the Kill Devil Hills Board of Commissioners unanimously adopted a resolution to begin the upset bid process, authorized by NC General Statute §160A-269, which permits the Town to sell real property by upset bid, after receipt of a valid offer for the property.  The resolution established the directions to be followed to meet the requirements of General Statutes for the sale of the property identified above. 
Persons wishing to upset the offer that has been submitted shall submit a sealed upset bid and their offer to the Town Clerk, P.O. Box 1719, Kill Devil Hills, NC 27948, or at the physical address, 102 Town Hall Drive, Kill Devil Hills, by 9:00 a.m. on Monday, March 22, 2021 (due to the actual tenth day falling on the weekend) eleven full days from the date of the first publication on Wednesday, March 10, 2021.  At 9:00 a.m. on Monday, March 22, 2021, the Town Clerk shall open all bids received, if any, and the highest such bid will become the new offer.  If there is more than one bid in the highest amount, the first such bid received will become the new offer.  
If a qualifying higher bid is received, the Town Clerk shall cause a new notice of upset bid to be published, and shall continue to do so until a 10-day period has passed without any qualifying upset bid having been received.  At that time, the amount of the final high bid shall be reported to the Board of Commissioners.  A qualifying bid is one that raises the existing offer by not less than ten percent (10%) of the first $1,000.00 of that offer and five percent (5%) of the remainder of that offer.  A qualifying bid must also be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier’s check, or certified check.  The Town will return the deposit of the final high bidder at closing. 

The terms of the final sale are that: 

1. The Board of Commissioners must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed. 
2. The buyer must pay with cashier’s check, or certified check at the time of closing. 
3. Conveyance of the property will be by a Special Warranty Deed for the property in fee simple. 

The Town of Kill Devil Hills reserves the right to withdraw the property from sale at any time before the final high bid is accepted, and also reserves the right to reject any and all bids at any time. 
If no qualifying bid is received after the initial public notice, the offer is hereby accepted as to price, with the remainder of the contractual terms being subject to negotiations between the Town and the offeror.
